PRIZE DRAW: TERMS AND CONDITIONS OF ENTRY
Who can enter:
The Prize Draw is open to all residents of the UK, who, at the time of entry are aged 18 or over, hold a full valid UK driving licence except for employees of the Promoter or its Affiliates and their immediate Family Members.
In these terms:
| “Promoter” | means Protyre, of Micheldever Tyres Ltd, Winchester SO21 3AP |
| “Affiliate” | means any subsidiary or holding company of the Promoter |
| “Family Member” | means a spouse, parent, adoptive parent, child or adopted child |
By entering the Prize Draw, entrants accept these terms and warrant that all the information submitted by in their entry is true.
Opening/closing date & time:
The Prize Draw in relation to Protyre (the “Promoter”) opens for entries via booking a FREE brake check at any Protyre centre online via the Protyre website between October 1st – December 31st 2017.
The Prize Draw closes for entries via the Protyre website on December 31st 2017.
Winner selection date:
The winner of the Prize Draw will be selected from all valid entries in a random draw to be conducted within 7 working days of the closing date.
How to enter:
No purchase is necessary.
Entrants may enter The Prize Draw by the following routes:
Online - go to www.protyre.co.uk and book a FREE brake check; only one entry per person is allowed.
IN-BRANCH – visit any of our Protyre centres and book a FREE brake check.
No bulk, third party or automated entries are permitted. The Promoter may disallow entries, refuse to award any prize, or seek its recovery, if there are signs that an entry was altered or tampered with or if it suspects an entrant has acted fraudulently or otherwise dishonestly in any way or if considers that an entry is not fully compliant with these terms . Only originals of hard copy entries will be accepted. Copies will be rejected as will entries which are incomplete or illegible.
Whilst not affecting any entrant’s statutory rights, the Promoter accepts no responsibility for:
entries that are lost, delayed, misdirected or incomplete or cannot be delivered or entered for any technical or other reason. Proof of delivery of the entry is not proof of receipt by the Promoter;
any damage, loss, liabilities, injury or disappointment incurred or suffered by any entrant as a result of entering the Prize Draw or accepting the prize;
any injury or damage to the entrant’s or any other person's computer or other device relating to or resulting from participation in or downloading any materials in connection with the Prize Draw; or
any delay or failure in complying with these terms due to circumstances outside its reasonable control. Such circumstances shall include, but not be limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, accidents, supervening legislation.
However, notwithstanding any other provision in these terms, the Promoter does not seek to limit its liability any loss or damage caused by its negligence, fraud or dishonesty or that of its agents, distributors or employees whilst working or acting for the Promoter.
The Promoter reserves the right to cancel or amend these terms or the basis of this prize promotion at any time without prior notice. Any changes will be posted within the rules on the Protyre website.
All decisions of the Promoter are final and binding and no discussion or correspondence will be entered into regarding the outcome of the prize promotion.
These terms and any issues or disputes which may arise out of or in connection with these terms (whether such disputes or issues are contractual or non-contractual in nature, such as claims in tort, for breach of statute or regulation or otherwise) shall be governed by and construed in accordance with English law. Entrants hereby irrevocably submit to the exclusive jurisdiction of the English courts to settle any such dispute or issues.
The Prize:
There is one prize consisting of:
A brand new unmodified VW up! manual car in white.
No cash or other alternative to the stated prize is available. However, if the stated prize is no longer available for any reason, the Promoter reserves the right to provide a similar prize or a prize of equal or greater value.
The winner is responsible for insuring the car and all other costs associated with taking up the prize. The winner may choose to register the car in another person’s name subject to receipt of correct and valid documentation for that person.
Notification of winner:
The winner will be notified by phone, e-mail or post using the information provided in the relevant entry within 14 days of the draw date. If the winner does do respond within 30 days, shall be disqualified and lose entitlement to the prize. Unclaimed prize will be void and may be used for future prize draws.
Publicity
By entering entrants agree to participate in reasonable publicity in the event that they are a winner. This may include use of their name and image, and town of residence in online publicity, in emails, and through any other print or social media.
The Promoter will use reasonable efforts to hand over the car within 28 days of receipt of all correct and valid documentation from the winner. Such documentation includes without limitation a valid insurance cover note to register the car and current driver’s licence.
The winner will be required to collect the car from their local Protyre centre at a press day, on a date to be confirmed.
Personal data
Entrants agree that by entering a prize draw their personal details may be stored and otherwise processed by the Promoter for the purposes of administering the prize draw and for the marketing and sending of other special offers. Entrants will be given the opportunity to unsubscribe on every email that we send.
Personal data provided by entrants will only be used in accordance with the Data Protection Act 1998 (“the Act”).
